§ 94-36. Cost sharing and completing the work.

  • (a)

    Except where public streets are scheduled to undergo major capital maintenance as defined by section 2-291 within two years, curb, gutter and sidewalk shall be maintained on a 50/50 cost sharing basis whereby the property owner shall pay one-half of the reasonable cost to replace or repair existing curb, gutter and sidewalk and the city shall pay the other half. The city shall pay the entire cost of existing curb, gutter and sidewalk replacement or repair for public streets that are scheduled to undergo major capital maintenance as defined by section 2-291 within two years. The reasonable cost shall be determined prior to March 15 of each year and shall be based upon the contract unit prices accepted by the city through a bid process or unit prices determined pursuant to section 2-171 et seq.

    (b)

    The property owner may elect to hire a contractor licensed pursuant to section 78-181 et seq. to perform the work. The property owner will be reimbursed by the city for half the reasonable cost, as determined by section 94-36(a), upon completion of the work, inspection and approval by the city, and receipt of a paid invoice from the contractor.

    (c)

    The property owner may elect, when offered by the city, to have the work performed by the city's contractor; however, the property owner's share of the reasonable cost shall either be paid prior to starting work or secured by a promissory note with interest-free monthly installments.
