§ 3.28.3. Approval criteria.

  • All annexations shall be reviewed for compliance with the following criteria. However, annexation is a discretionary, legislative act. The City shall never be compelled to annex, unless otherwise required by state law, even if all these Approval Criteria have been satisfied.

    A.

    The annexation is in compliance with the Municipal Annexation Act of 1965 (CRS § 31-12-101, et seq., as amended).

    B.

    The annexation is in accord with the Comprehensive Plan and the best interests of the City would be served by annexation of such property.

    C.

    The property is capable of being integrated into the City and developed in compliance with all applicable provisions of this Code and the Arvada City Code.

    D.

    At the time any development of the area proposed to be annexed is completed, there will be capacity to adequately serve residents of such area with all necessary utilities and facilities.
