§ 86-31. Definitions.

  • The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Base salary means that regular monthly or annual pay received by an employee, inclusive of overtime, for services performed, but which would include the proportionate amount of longevity for that month or year, but shall not include commissions, reimbursement of expenses or bonuses. No other benefits shall be included in the computation of base salary.

    Beneficiary means any person, other than a retirant, in receipt of a pension payable from funds provided by the retirement system.

    Board means the board of trustees provided for in this chapter.

    Compensation means the salary paid by the city to a member for service rendered by him to the city as a police officer.

    Credited compensation means the total amount of compensation paid to a member annually by the city for all personal services performed while the member is a police officer, including overtime pay, longevity pay, and contributions made by the city pursuant to sections 125, 414(h), or 457 of the Internal Revenue Code of 1986, as amended. Commissions, reimbursement of expenses, and bonuses are not included in credited compensation. No other benefits are included in credited compensation.

    Credited service means service credited to a member to the extent provided under this chapter.

    Disability pay means that compensation paid to a member on disability status in equal monthly installments from funds of the retirement system.

    Disability status means the inability of a member to perform the duties of his regular occupation, taking into consideration the member's training, education and experience. Such status may be temporary or permanent according to the determination of the board.

    In the performance of duty or by reason of service means all service performed as a police officer for the city, whether on duty or off duty and shall specifically include services rendered in connection with the special off-duty police assignments.

    Member means any person included in the membership of the retirement system and shall include all police officers as defined in this section.

    Pension means an amount payable, in equal monthly installments, from funds of the retirement system to a retirant.

    Police officer means an employee of the police department holding the rank of patrol person, including probationary patrol persons, or higher rank. The term "police officer" shall not include:

    (1)

    Private employed police officers;

    (2)

    Persons temporarily employed as police officers during emergencies; and

    (3)

    Civilian employees of the police department.

    Retirant means a member who retires with a pension payable under the provisions of this chapter.

    Retirement means withdrawal from the service with a pension payable from funds of the retirement system.

    Retirement system means the city police officers' retirement system created and established under the provisions of this chapter.
