§ 6-1. Definitions.

(a)

The following words, terms and phrases, when used in this chapter, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

Alcoholic beverages shall have the meaning set forth in C.R.S. § 44-3-103(2), as may be amended from time to time.

Applicant shall mean and include:

(1)

If an individual, that person making an application for license or permit under this chapter.

(2)

If a partnership, all the partners of the partnership which is making application for a license under this chapter.

(3)

If a corporation, any officer, director, manager or any stockholder therein.

Authority or licensing authority means the local licensing authority of the City of Arvada.

City clerk, as used in this chapter, shall include the city clerk of the city or their designee.

Fermented malt beverage shall have the meaning set forth in C.R.S. §§ 44-4-103(1)(a-b) as may be amended from time to time.

Malt liquors shall have the meaning set forth in C.R.S. § 44-3-103(30) as may be amended from time to time.

Manager means and includes that person or those persons who manage, direct, supervise, oversee and administer the acts, transactions and acts of servants of the establishments governed by this chapter.

Open container means any bottle, can, box, glass, or other device used for the storage and/or sale of beverage, which has had its cap or other permanent seal broken so as to allow access to its contents. Further, the words "open container" means any item used for the storage or transport of beverage which has no permanent cap, top, or sealer.

Person whenever it appears in this chapter shall be deemed to include a natural person, partnership, association, company, corporation, organization or manager, agent, servant, officer or employee of any of them.

Public property means any real property owned by the State of Colorado or any county, municipality, or other political subdivision thereof, or any special district.

Spirituous liquors shall have the meaning set forth in C.R.S. § 44-3-103(54) as may be amended from time to time.

Vinous liquors shall have the meaning set forth in C.R.S. §§ 44-3-103(59)(a-b) as may be amended from time to time. .

(b)

All other words and phrases used in this chapter not otherwise defined herein shall have the meanings attached by the state statutes regulating the sale of liquor and fermented malt beverages, or if not otherwise defined by law, are used in their common and accepted sense and meaning.
