§ 58-9. Presumption of willful act.

  • For purposes of prosecution under this section, proof that the summons or subpoena was duly served, that the person was not excused from appearance by the court and that the person failed to appear at the time scheduled shall raise a rebuttable presumption that the failure to appear was willful.
