§ 58-2. Initiation of prosecution; contents of summonses and complaints.

  • (a)

    Prosecutions in the municipal court shall be initiated by the:

    (1)

    Issuance of a summons and complaint; or

    (2)

    Filing of a complaint following an arrest; or

    (3)

    Filing of a summons and complaint following arrest.

    (b)

    Every summons and complaint shall state the name of the defendant, the Code section number or ordinance and section number alleged to have been violated, the general type of offense to which each such section or ordinance relates, the date and place of each alleged violation, that the defendant is known or believed to have committed such offense, and that the defendant is required to appear to answer the charges on a date and at a time and place designated in the complaint or summons.

    (c)

    For purposes of this article, police officers, animal management officers, police service technicians, police department licensing investigators, parking enforcement officers or as designated by the Arvada police chief, building, technical, and zoning code enforcement officers, finance department collections agents, and those fire marshals appointed by the chief of the city, Coal Creek, or Adams County fire protection district and approved by the chief of police of the city as fire arson investigators in the city shall be deemed to be peace officers.
