§ 54-31. General.

  • (a)

    Adoption. Pursuant to C.R.S. tit. 31, art. 16, pts. 1 and 2, as amended, and Section 5.11 of the Charter for the City of Arvada, Colorado, the city council hereby adopts by reference the 2010 edition of the "Model Traffic Code for Colorado," promulgated and published by the Colorado Department of Transportation, Safety and Traffic Branch, 4201 East Arkansas Avenue, Denver, CO 80222. The Model Traffic Code is adopted as if set out at length except for any deletions, additions, amendments, or modifications as set forth herein. This includes the adoption by reference of the Model Traffic Code Appendix entitled "Definitions."

    (b)

    Short title. This article may be known and cited as the "Model Traffic Code" or the "MTC."

    (c)

    Purpose. The purpose of this article is to provide a system of traffic regulations consistent with state law and generally conforming to similar regulations throughout the state and nation.

    (d)

    Interpretation.

    (1)

    This article shall be so interpreted and construed as to effectuate its general purpose to make uniform the local traffic regulations contained herein. Article, part, or section headings of this chapter and the primary and secondary code adopted herein shall not be deemed to govern, limit, modify, or in any manner limit the scope, meaning, or extent of the provisions of any article or section thereof.

    (2)

    Whenever certain hours are set forth anywhere within this chapter, they shall be interpreted to mean standard time or daylight-saving time as are or were in use in the city at the time of the alleged violation.

    (e)

    Application. This article shall apply to every street, alley, sidewalk area, driveway, park, and to every other public way or public place or public parking area, either within or outside the corporate limits of this city, the use of which this city has the jurisdiction and authority to regulate. The provisions of [MTC] sections 606, Display of unauthorized signs or devices; 1203.3, Parking in fire lane prohibited; 1208, Parking privileges for persons with disabilities-applicability; 1211, Limitations on backing; 1401, Reckless driving; 1402, Careless driving; 1409, Compulsory insurance; and 1413, Eluding or attempting to elude a police officer, shall apply throughout the jurisdiction of this city.

    (f)

    Adoption by reference of other codes. Pursuant to C.R.S. tit. 31, art. 16, pts. 1 and 2, as amended, and Section 5.11 of the Charter for the City of Arvada, Colorado, the city council hereby adopts by reference the following as primary codes together with such amendments and modifications as may be adopted by the publishing agencies:

    (1)

    The 2009 edition of the "Manual on Uniform Traffic Control Devices for Streets and Highways," ("MUTCD") published by the United States Department of Transportation, Federal Highway Administration, and available from the Superintendent of Documents, U.S. Government Printing Office, Washington, DC 20402; and

    (2)

    The "Colorado Supplement to the Federal Manual on Uniform Traffic Control Devices 2009," adopted by the Transportation Commission of Colorado on December 15, 2011, and issued by the Colorado Department of Transportation, Safety and Traffic Engineering Branch, 4201 East Arkansas Avenue, Denver, CO 80222.

    These two codes provide for and contain standards and specifications for uniform traffic control devices. Future amendments, supplements, and reenactments of these publications shall be adopted and incorporated by reference herein, but shall apply to streets or highways designated as part of the state highway system only if that amendment, supplement, or reenactment is approved by the Colorado Department of Transportation. For purposes of this chapter, whenever official traffic control devices are placed in position approximately conforming to the requirements of this chapter, such devices shall be presumed to have been so placed by the official act or direction of lawful authority unless the contrary shall be established.

    (4)

    In the event of any conflict or inconsistency between the Model Traffic Code and the MUTCD or the Colorado Supplement thereto, the Model Traffic Code shall control. In the event of any conflict or inconsistency between the provisions of this chapter and the Model Traffic Code, this chapter shall control.

    (g)

    Copy on file. A copy of the Model Traffic Code, the MUTCD, and the Colorado Supplement thereto are on file in the office of the city clerk and may be inspected during regular business hours.
